Content Victim Service Definition:

For purposes of these Terms of Service, the term Content Victim Service shall mean Content Victim news, content and data feeds, software, Content Victim services, Content Victim websites (including, without limitation, www.contentvictim.com) and all other software, features, tools, web sites and services provided by or through Content Victim and its business divisions and Content Victim’s third-party vendors.

Grant of Limited License:

Content Victim and its vendors grant you a revocable, non-transferable, non-sub licensable, non-exclusive and limited license to use the Content Victim’s Services in form only on any computer or device from which you wish to access the Content Victim Service in accordance with these Terms of Service.

You may not sub-license, resell, redistribute, re-syndicate, or access the service without first obtaining written permission from Content Victim. You may not sell, assign, grant a security interest in or otherwise transfer any right in the Content Victim Service, Software or incorporate it (or any portion of it) into another product without the written consent and permission of Content Victim.

You may not translate, reverse-engineer or reverse-compile or decompile, disassemble, make derivative works from, or otherwise attempt to discover any source code in the Content Victim Service, Product or Software. You may not modify the Content Victim Service, Product or Software or use it in any way not expressly authorized by these Terms of Service. Finally, you may not authorize or assist any third party to do any of the things described in this paragraph.

Nature of Internet Services:

Customer/user of this portal acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of Content Victim and that damages resulting from any interruption of service are difficult or impossible to ascertain. Therefore, user agrees that Content Victim shall not be liable for any damages arising from such causes beyond the direct, exclusive and immediate control of Content Victim.

Disclaimer of Warranties:

Content Victim disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed in the Content Victim services results.

The Content Victim Services, And All Materials, Information, Products And Services Included In The Content Victim Services Are Provided ‘As Is,’ With No Warranties Whatsoever. Content Victim And Its Licensors Expressly Disclaim To The Fullest Extent Permitted By Law All Express, Implied, And Statutory Warranties, Including, Without Limitation, The Warranties Of Merchantability, Fitness For A Particular Purpose, And Non-Infringement Of Proprietary Rights. Content Victim And Its Licensors Disclaim Any Warranties Regarding The Security, Reliability, Timeliness, And Performance Of The Content Victim Services. Content Victim And Its Licensors Disclaim, Any Warranties For Any Information Or Advice Obtained Through The Content Victim Services.

You Understand And Agree That You Download Or Otherwise Obtain Material Or Data Through The Use Of The Content Victim Services At Your Own Discretion And Risk And That You Will Be Solely Responsible For Any Damages That Results From The Download Of Such Material Or Data.

Limitation of Liability:

Under No Circumstances Shall Content Victim Or Its Licensors Be Liable To Any User On Account Of That Users Use Or Misuse Of Or Reliance On Content Victim Services. Arising From Any Claim Relating To This Agreement Or The Subject Matter Hereof Such Limitation Of Liability Shall Apply To Prevent Recovery Of Direct, Indirect, Incidental, Consequential, Special, Exemplary, And Punitive Damages Whether Such Claim Is Based On Warranty, Contract, Tort (Including Negligence), Or Otherwise, (Even If Content Victim Or Its Licensors Have Been Advised Of The Possibility Of Such Damages). Such Limitation Of Liability Shall Apply Whether The Damages Arise From Use Or Misuse Of And Reliance On The Content Victim Services, From Inability To Use The Content Victim Services, Or From The Interruption, Suspension, Or Termination Of The Content Victim Services (Including Such Damages Incurred By Third Parties). This Limitation Shall Also Apply With Respect To Damages Incurred By Reason Of Other Services Or Goods Received Through Or Advertised On The Content Victim Services Or Received Through Any Links Provided In The Content Victim Services, As Well As By Reason Of Any Information Or Advice Received Through Or Advertised On The Content Victim Services Or Received Through Any Links Provided In The Content Victim Services. This Limitation Shall Also Apply, Without Limitation, To The Costs Of Procurement Of Substitute Goods Or Services, Lost Profits, Or Lost Data. Such Limitation Shall Further Apply With Respect To The Performance Or Non-Performance Of The Content Victim Services Or Any Information Or Merchandise That Appears On, Or Is Linked Or Related In Any Way To, The Content Victim Services. Such Limitation Shall Apply Notwithstanding Any Failure Of Essential Purpose Of Any Limited Remedy And To The Fullest Extent Permitted By Law.

Without limiting the foregoing, under no circumstances shall Content Victim or its licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Confidentially and Non-Disclosure:

Due to the proprietary nature of the Service and the valuable trade secrets of Content Victim contained therein, Subscriber specifically agrees not to disclose or divulge any information whatsoever about the Service or the related business practices of Content Victim, or direct others to do so without the prior express written consent of Content Victim. In the event that Subscriber violates this section, Subscriber hereby agrees to waive all rights to any judicial appeal of this section and this determination, and hereby stipulates that a court of competent jurisdiction shall enter judgment in favour of Content Victim. Subscriber acknowledges and agrees that this section shall in no way infringe upon the rights of Content Victim to pursue other legal remedies or to collect other damages for additional or other legal causes of action, and that this section shall be applicable and enforceable regardless of whether Content Victim pursues any other such legal remedies, and regardless of the outcome of any such actions.

Disclosure to Law Enforcement:

Content Victim specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that Content Victim may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition Content Victim shall have the right to terminate all service set forth in this Agreement.

All trademarks appearing on the Content Victim Services Products are the property of their respective owners, including, without limitation, Content Victim Inc.
